A RESOLUTION REQUESTING
HON. JEFFREY DOMINGO KHONGHUN REPRESENTATIVE 1ST DISTRICT OF ZAMBALES
TO PROPOSE A BILL FOR THE RE-CLASSIFICATION OF A PARCEL OF LAND COVERING ONE
HUNDRED (100) HECTARES SITUATED AT PINAGPALA AND IRAM RESETTLEMENT AREA, NEW
CABALAN, OLONGAPO CITY FROM OLONGAPO WATERSHED FOREST RESERVE PER LAND CLASSIFICATION
MAP NO. 2427 APPROVED JANUARY 31, 1961 TO MULTIPLE USE ZONE IN A MANNER
CONSISTENT WITH LAW
WHEREAS, in 1989 the residents of Pinagpala, Iram Resettlement New Cabalan,
Olongapo City organized and established
an association known as Samahang Pinagpalang Komunidad sa Olongapo, Inc.
(SPKOI) in order to have a common goals for progress and nurturing of land which they are tilling;
WHEREAS,
in 1991 the Mount Pinatubo has erupted resulting to the
displacement of several families and Iram Resettlement Area in New Cabalan,
Olongapo City was established and built thus on May 25, 1992 the late
President Corazon C Aquino issued and signed a Proclamation No. 906 giving one
hundred (100) hectares and named it as Iram Resettlement Area for the victims
of Mount Pinatubo eruption ;
WHEREAS,
after five years from 1992 twenty-six (26) hectares were separated
from the one hundred (100) hectares and were awarded to ninety three (93) members
of Samahang Pinagpalang Komunidad sa Olongapo Inc. (SPKOI) pursuant to Executive Committee Resolution
No. 751 of Mount Pinatubo Commission ;
WHEREAS,
the Samahang Pinagpalang Komunidad sa Olongapo Inc. (SPKOI) was awarded
Certificate of Community Forest Stewardship (CCFS) by the Mount Pinatubo
Commission;

WHEREAS,
the members continued the occupation of the property within the Pinagpala,
Iram Resettlement Area, New Cabalan, Olongapo City until the leader of the
association abused his power and has acted prejudicial to the welfare of the
association thus the appropriate complaint was filed before the Department of
Environment and Natural Resources which eventually resulted to the cancelation
of Certificate of Community Forest Stewardship (CCFS) on May 13, 2003;
WHEREAS, after the cancellation of Certificate of Community
Forest Stewardship (CCFS) the occupants of the property of Pinagpala Iram
Resettlement Area, New Cabalan, Olongapo City continued to cultivate, maintain
and occupy their respective premise;
WHEREAS,
on February 3, 2004 Olongapo Iram Hillside Association, Inc. (OIHAI) was
organized and elected their officers to represent the association;
WHEREAS,
Olongapo Hillside Association, Inc (OIHAI) was duly registered with the Securities
and Exchange Commission on February 2004;
WHEREAS, on July 1, 2008 the President of Olongapo Iram
Hillside Association, Inc. (OIHAI) received a letter communication from USEC
Diony Ventura of National Mapping and Resources Information Authority relating
to their inquiry as to their rights over the lands they occupied and the matter
was referred to the Department of Environment
and Natural Resources;
WHEREAS, on February 24, 2015 the Community Environment and Natural
Resources Office (CENRO), Department of
Environment and Natural Resources (DENR) Olongapo City sent a letter to
the President of Association stating that the area claimed and occupied by the
association falls within the proclaimed as Olongapo Watershed Forest Reserve
per Land Classification Map No. 2447 and re-classification with the said
forest land shall only be allowed through the act of Congress with the
initiative of the Local Government Unit.
NOW,
THEREFORE, on motion of City Councilor Noel Y. Atienza, with the unanimous
accord of the Members of the Sangguniang Panlungsod present.
RESOLVED,
AS IT IS HEREBY RESOLVED, by the Sangguniang Panlungsod in session
assembled to request as it hereby
requests Hon. Jeffrey Domingo Khonghun Representative 1st
District of Zambales to propose a bill for the re-classification of a parcel of
land covering one hundred (100) hectares situated at Pinagpala and Iram
Resettlement Area New Cabalan, Olongapo City from Olongapo Watershed Forest Reserve
Per Land Classification Map No. 2427 approved on January 31, 1961 to Multiple
Use Zone in a manner consistent with laws.
Let
copies of this Resolution be furnished the Office of Congressman Jeffrey
Domingo Khonghun and Department of
Environment and Natural Resources.
