RESOLUTION INTERPOSING NO OBJECTION TO THE APPLICATION
OF
SUPER 88 FORTUNE CORPORATION TO OPERATE
AND MANAGE
PAGCOR
E-BINGO STATION IN OLONGAPO CITY, IN A MANNER
CONSISTENT
WITH LAW
WHEREAS, Super 88
Fortune Corporation of Olongapo City has signified its intention to operate and
manage PAGCOR E-Bingo with business address at #111 National Highway,
Barangay Barretto, Olongapo City;
WHEREAS, Philippine
Amusement and Gaming Corporation (PAGCOR) has required Super 88 Fortune
Corporation to secure a “Resolution of No Objection” from the City where the
said business unit considering that it has already authorized its operation.
WHEREAS, the
City Planning and Development Office (CPDO) confirms in their letter dated
April 2015 that the above-mentioned business unit meet the requirement of
Article VI, Section 5.f of the Zoning Ordinance that “recreational centers/
establishments are allowed in Commercial Zone provided that it shall not be
located within twenty (20) meters from any institutional structure;”
WHEREAS;
the City Planning and Development Office (CPDO) further confirms that the new
site falls within Tourism Conservation Zone – 2 where in use regulations in the
said area includes resorts, pension houses, hotels, lodges, clubhouses,
vacation houses, play courts and other commercial activities with reference to
tourism are allowed subject to Zoning Certification. Operations of PEGS3 and
E-Bingo are activities considered to be tourism related.
WHEREAS, the
City Government of Olongapo confirms that it interposes no objection to the
application of Super 88 Fortune Corporation to operate and manage PAGCOR
E-Bingo in Olongapo City provided that the same is in accordance with the
City’s Zoning Ordinance and the City regulation;

WHEREAS, strict
control over the admission of persons under 21 years of age shall be
administered in the gaming area as stated in Presidential Decree No. 1869
otherwise known as: “Consolidating And Amending Presidential Decree Nos.
1067-A, 1067-B, 1067-C, 1399 And 1632, Relative To The Franchise And Powers Of
The Philippine Amusement and Gaming Corporation (PAGCOR) under Title IV,
Section 14, No. 2.c;”
NOW, THEREFORE, on
motion of City Councilor Aquilino Y. Cortez, Jr. with the unanimous accord of
the Members of the Sangguniang Panlungsod present;
RESOLVED, AS IT IS HEREBY RESOLVED, by
the Sangguniang Panlungsod in session assembled, to interpose, as it hereby
interposes no objection to the application Super 88 Fortune Corporation to
operate and manage PAGCOR E-Bingo in Olongapo City in a manner consistent with
law.
RESOLVED FURTHER, AS IT IS HEREBY
FURTHER RESOLVED, that a copy of the Certificate of Urgency dated November 10,
2015 issued by the City Mayor Rolen C. Paulino be an integral part of this
resolution.
