RESOLUTION AUTHORIZING THE CITY MAYOR, HONORABLE ROLEN C. PAULINO TO
NEGOTIATE, ENTER INTO AND SIGN THE CONTRACT OF LEASE WITH THE WINNING BIDDER AS
REGARDS TO THE LEASE OF SCHOOL CANTEEN AT THE GORDON COLLEGE IN A MANNER
CONSISTENT WITH LAW
WHEREAS, Article X Section 5 of the 1987
New Constitution provides: “Each local government unit shall have the
power to create its own sources of revenues and to levy taxes, fees and charges
subject to such guidelines and limitations as the Congress may provide,
consistent with the basic policy of local autonomy. Such taxes, fees and charges shall accrue
exclusively to the local governments”;
WHEREAS, Section 22 (a) of Republic Act
No. 7160 otherwise known as the Local Government Code of 1991 states: “Every
local government unit, as a corporation, shall have the following powers”;
(1) To
have continuous succession in its corporate name;
(2) To
sue and be sued;
(3) To
have and use corporate seal;
(4) To
acquire and convey real or personal property;
(5) To
enter into contracts; and
(6) To
exercise such other powers as are granted to corporations, subject to the
limitation provided in this Code and other laws.

WHEREAS, Section 455 (b) (1) (vi) of
Republic Act No. 7160 otherwise known as the Local Government Code of 1991
expressly states: “Represent the city in
all its business transactions and sign in its behalf all bonds, contracts, and
obligations and such other documents upon authority of the Sangguniang
Panlungsod or pursuant to law or ordinance” ;
WHEREAS, the City of Olongapo has
maintained and operating a Community College inside the East Tapinac Oval Track
which was newly constructed to house the said community college;
WHEREAS, in the exercise of its official
duties and powers, the local chief executive has started to call for any
interested parties to submit their bid
for the operation and establishment of college canteen therein;
WHEREAS, after the required conduct of
public bidding, the operation and establishment of college canteen was awarded
to Pilcat’s Canteen through it’s owner Alma Jessica Dayola;
NOW, THEREFORE, on motion of City Councilor
Noel Y. Atienza, with the unanimous accord of the Members of the Sangguniang Panlungsod
present;
RESOLVED, AS IT IS HEREBY
RESOLVED, by the Sangguniang Panlungsod in session
assembled, to authorize as it hereby authorizes the City Mayor Honorable Rolen
C. Paulino to negotiate, enter into and sign the contract of lease with the
winning bidder as regards to the lease of school canteen at the Gordon College
in a manner consistent with law.
